CLASSIC FOR AGENT'S WEB SITE
Please read these Terms and Conditions carefully. By using this web site, you hereby agree to comply with and be bound by these Terms and Conditions.

These Web Site Terms and Conditions (these "Terms and Conditions") apply to your access to, and use of, the www.classicforagents.com web site (the "Site") and do not alter in any way the terms or conditions of any other agreement you may have with Classic for Agents for products, services or otherwise (including, without limitation, if applicable, your Classic Online Booking Travel Agency User Agreement).

Classic for Agents reserves the right to amend at any time any policies governing the Site, including these Terms and Conditions and Classic for Agents' Privacy Policy, by posting the amended terms on the Site and indicating the date of the last revision. Such amended terms will be effective immediately after they are initially posted on the Site. If you do not accept the amended terms, you must cease using the Site.

USE OF THIS WEB SITE
Use of Site: The Site is provided solely for your personal and noncommercial use. The content and information on the Site (including, without limitation, price and availability of travel products and services), as well as the infrastructure used to provide such content and information, is proprietary to Classic for Agents or its suppliers and providers. As a condition of using the Site, you agree not to use the Site or its contents or information for any commercial or nonpersonal purpose (direct or indirect). You agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information obtained from the Site. Additionally, you hereby agree not to:
  1. access, monitor or copy any content or information of the Site using any robot, spider, scraper or other automated means or any manual process for any purpose without the express written permission of Classic for Agents;
  2. violate the restrictions in any robot exclusion headers on the Site or bypass or circumvent other measures employed to prevent or limit access to the Site;
  3. take any actions that impose, or may impose, in the discretion of Classic for Agents, an unreasonable or disproportionately large load on the Classic for Agents infrastructure; or
  4. deep-link to any portion of the Site for any purpose without the express written permission of Classic for Agents.
As a condition of your use of the Site, you warrant that you will not use the Site for any purpose that is unlawful or prohibited by these Terms and Conditions.

Privacy Policy: Classic for Agents believes strongly in protecting user privacy. Please refer to our Privacy Policy for information on how Classic for Agents uses, collects and protects information.

Links to Third-Party Sites: The Site may contain hyperlinks to Web sites operated by parties other than Classic for Agents. Such hyperlinks are provided for your reference only. Classic for Agents does not control such Web sites and is not responsible for their contents. Classic for Agents' inclusion of hyperlinks to such Web sites does not imply any endorsement of the materials on such Web sites or any association with their operators.

TRAVEL BOOKING TERMS AND CONDITIONS

By making a deposit payment or paying in full for your Classic Vacations vacation, you acknowledge and agree to the terms and conditions set forth below:

Travel Bookings: You agree to be financially responsible for all of the travel products and services booked through your account with Classic Vacations ("Classic"). In addition, you warrant that all information supplied by you or anyone using your account to Classic Vacations in connection with the booking of travel products is true and accurate. Without limitation, any speculative, false, or fraudulent reservation, or any reservation made in anticipation of demand is prohibited. You agree to make only legitimate travel services bookings for yourself or for another person for whom you are legally authorized to act.

Reservations: Contact your Travel Agent.

Prices: Prices are subject to change without notice. Prices are quoted per person based on double occupancy. All applicable taxes at the time of booking are included in the price of the vacation. Fees or other charges such as resort fees, surcharges, resort fees or taxes imposed by the airline after your vacation purchase (if any), are solely your responsibility. Some airport departure fees may not be included and must be paid directly to the airline. Ask your Travel Specialist about discounts and value-added specials.

Payments: For all bookings made forty-five (45) days or more prior to departure, a deposit of $150 per person is required by Classic within five (5) days of making your reservation. If your deposit is not received by Classic within 5 days, your booking will be automatically canceled. Payment in full is due forty-five (45) days prior to departure unless otherwise noted. Full payment is due immediately for bookings made within forty-five (45) days of departure. Hotels may require full payment at time of booking for high-demand periods. Villas and yachts require a 50% deposit at time of booking. Most published airfares require full payment and immediate ticketing.

Forms of Payment: Payment may be made by agency check, American Express, Diners Club, Discover Card, MasterCard, Optima, or Visa credit card. All returned checks are subject to a $35 service charge.

Last Minute Bookings: Classic accepts last-minute reservations provided space is available and full payment has been received. There are no last-minute booking fees. Non-refundable express-mail charges may apply.

Price Protection: All bookings are price-protected upon receipt of deposit by Classic and purchase of the Travel Smart Plan, or when full payment is received for the entire booking. Published airfares require full payment at time of booking to qualify for price protection. Tax increases, fuel, airport and other surcharges, and consumer-initiated changes are not price-protected.

Change & Cancellation Fees: You will be charged $50 per adult by Classic for all passenger-initiated changes or cancellations made after receipt of deposit up to thirty-one (31) days before departure. A fee of $100 per adult will be charged by Classic for all passenger-initiated changes or cancellations made 30 days or less prior to travel. Carrier, property, and provider change and cancellation policies vary. Hotels and condominiums may charge a fee. Villas may charge the full amount regardless of cancellation date. Airlines may charge significant change and cancellation fees, which vary by carrier. Name changes are treated as a cancellation and all cancellation fees apply. Once travel has commenced, any changes or cancellation will be at the expense of the passenger unless the Travel Smart Plan has been purchased. To avoid many of these charges, ask for the “Travel Smart Plan.”

Travel Smart Plan: With the Travel Smart Plan, we will waive Classic’s standard fees, which are described above. Travelers 17 years of age and younger are covered at no cost when all adults in your traveling party purchase the Travel Smart Plan. The Travel Smart Plan must be purchased at time of booking. It is not refundable. Below is an overview of the benefits of the Travel Smart Plan. Please refer to www.classicforagents.com/travelsmart for complete plan details, including coverage exclusions and limitations.

The Travel Smart Plan protects you against:

SECTION I: Provided by Classic

With some exceptions and limitations, the Travel Smart Plan protects you against:
  • Classic change or cancellation fees (prior to travel).
  • Most carrier, property and tour and activity provider change and cancellation penalties.
  • Hotel, air, and rental car price increases (unless you make a change that results in a higher price).
  • If you return early from your vacation, Classic will refund all unused hotel and car rental components originally booked through Classic, provided that minimum stay requirements have been met.
  • Commission Protection: 50% of earned commission up to $250 per booking. To qualify the travel agency must achieve a minimum annual sales threshold of $25,000. Qualified bookings require the purchase of the Travel Smart Plan. 50% of earned commission up to $500 per booking. To qualify the travel agency must achieve a minimum annual sales threshold of $500,000. Qualified bookings require the purchase of the Travel Smart Plan. Classic reserves the right in its sole discretion to cancel or modify this program or to remove participants without liabiility to them or any third party.
SECTION II

The Travel Smart Plan includes insurance coverage whose benefits are administered by Travel Guard International on behalf of National Union Fire Insurance Company of Pittsburgh, PA. Certain exclusions and limitations apply and are detailed in the Description of Coverage. This plan is valid only if the appropriate plan cost has been paid at the time of booking. This is a comprehensive travel protection plan including travel insurance, medical coverage, medical evacuation, accidental death, lost, stolen or delayed baggage and other emergencies. For complete details regarding coverage, including exclusions and limitations, please refer to the Description of Coverage included with your final travel documents.

What is not covered
  • The Waiver does not cover no shows, missed flights, name changes, lost or stolen tickets, or lack of proper documentation for departing or re-entering the U.S.
  • Tax increases (including fuel, airline and airport surcharges)
  • Client-initiated changes which result in fare or accommodation cost increases
  • Air routing changes
  • Changes requested to carrier initiated schedule changes
  • Excess baggage charges
  • Changes in occupancy for shared accommodations
  • Private jet charters, yachts, cruises, and some villas
Restrictions

No refunds are allowed on unused portions of airline tickets. Once travel has commenced, routing and/or class of services changes are not permitted. A maximum of two changes are allowed on published air and other restricted air fares per person per booking. Tax changes, surcharges, and consumer-initiated changes that result in a higher cost are not price-protected. For refunds on special or weekly rates for accommodations and/or car rentals, the used portion will be charged at regular published daily rates. When changing destinations after the Travel Smart Plan has been purchased, the client is responsible for paying the difference (if any) in the new Travel Smart Plan price. Name changes will be treated as a cancellation and all cancellation fees will apply. Classic Vacations reserves the right to suspend offering and selling the Travel Smart Plan at any time.

Refunds: Unused portions of airfare are nonrefundable. Unused portions of your land package (e.g., hotel accommodations, car rentals, tours and activities) will not be refunded for any reason unless the Travel Smart Plan has been purchased. For changes or cancellations prior to departure, Classic will remit a refund to you or your Travel Agent within 30 days, less the following: (i) Supplier charges for change or cancellation (which vary and may be significant); (ii) Administrative charge by Classic for processing the change or cancellation (unless the Travel Smart Plan has been purchased); (iii) Nonrefundable airline tickets will not be refunded once ticketed; (iv) Refundable airline tickets must be canceled before ticketed departure date; (v) All ticketing service fees; (vi) All express-mail fees; and (vii) Purchase price of each Travel Smart Plan.

Force Majeure: Except to the extent covered by the Travel Smart Plan that you have purchased at the time of booking, Classic Vacations and its affiliates have no liability for and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond their direct and reasonable control.

Easter & Christmas Reservations: Various hotels, villas and condominiums have special cancellation, change, minimum nights, and refund policies for stays during holiday periods and may not be covered by the Travel Smart Plan.. Deposits for Christmas and Easter bookings are non-refundable. Dates for which this policy applies vary by destination. Contact your Personal Travel Specialist for more information.

Documents: With each booking, Classic Vacations will issue you a personalized travel wallet. Documents will be released upon receipt of full payment and mailed at least 21 days prior to departure. Documents may be requested earlier if full payment has been received by Classic Vacations. Airline tickets are issued with documents in accordance with air carrier policies.

Travel Destinations: Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. Classic Vacations urges passengers to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, www.treas.gov/ofac, and www.customs.gov.

BY OFFERING FOR SALE TRAVEL TO PARTICULAR INTERNATIONAL DESTINATIONS, CLASSIC VACATIONS DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND IS NOT LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.

RULES AND REGULATIONS ON TRAVEL PRODUCTS
Separate Terms and Conditions of Travel Products and Services: Separate terms and conditions will apply to your reservation and booking of travel-related goods and services that you select. You agree to abide by the terms or conditions imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability and use of fares, products or services. You understand that any violation of any such supplier’s conditions may result in cancellation of your reservation(s) or booking, in your being denied access to any flights, hotels or automobiles, in your forfeiting any monies paid for such reservation(s) or booking, and in Classic Vacations debiting your account for any costs Classic Vacations incurs as a result of such violation. You will be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your booking of travel products and services from Classic Vacations.

Air Transportation: All airline tickets are purchased and issued on a round-trip basis. Departure fees are not included. No refunds are allowed on unused portions. Changes to flight itineraries may result in an increased airfare, a carrier-imposed charge or, in some instances, may not be permitted. Once travel has commenced, routing and/or class-of-service changes are not permitted. Additional cancellation fees are assessed by the airline on special fares. Classic passengers are subject to all airline limitations, liabilities, and tariffs. All air carriers booked by Classic shall be liable only as common carriers to Classic passengers. Classic is not responsible for schedule changes or airline strikes. Some countries charge a separate departure tax that is collected at the airport and typically must be paid for in the local currency. This tax is not included in your fare. Name changes are not allowed. Classic is not responsible for multiple connections due to schedule changes.

Rental Cars: Car-rental rates reflect unlimited mileage for a 24-hour rental period. Overtime fees are paid directly to the car company by client. Some locations may require a voucher. International driver’s license fees are to be paid directly to the car company by client. No refunds will be made on car rentals of less than 24 hours. There will be drop charges assessed for car rentals returned to alternate car-rental stations, to be paid directly to the car company. The renter is responsible for paying directly to the car- rental company all charges not covered by Classic’s booking. Car-rental companies require that drivers possess a valid driver’s license and major credit card or leave a cash deposit upon pick-up. Drivers must be at least 25 years of age. Additional drivers must be at least 25 years old. An additional-driver fee may apply and must be paid directly to the car company.

Family Plan: Many hotels, villas and condominiums offer discounts for children when accompanied by full-paying adults. Maximum occupancy may vary when children on family-plan programs are included. Some hotels may not allow children or restrict children of certain ages. Some airlines offer children’s rates.

Bedding & Maximum Occupancy: Classic Vacations will request the bedding desired, although the requested bedding cannot be guaranteed. At some hotels, villas and condominiums there may be an additional charge if a crib or rollaway is required. These charges are payable to the property upon check-out.

Physical Disabilities: Any physical disability requiring special attention, treatment, or facilities must be communicated to Classic Vacations when the booking is made.

Minimum Stays: The length of stay required varies by property, season and airline tariff.

Not Included: Gratuities, meals (except where otherwise noted), telephone calls, airport departure fees, resort fees, local driver’s license, car seats, gas, parking, rental-car overtime fees, some airport departure taxes, and any other items of a personal nature.

CLASSIC VACATIONS AND ITS AFFILIATES ARE NOT LIABLE FOR THE ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, BREACHES OR NEGLIGENCE OF ANY SUCH SUPPLIERS OR FOR ANY PERSONAL INJURIEIS, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING THEREFORM.

IN NO EVENT SHALL CLASSIC VACATIONS, ITS AFFILIATES AND/OR THEIR RESPECTIVE SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THIS WEB SITE OR WITH THE DELAY OR INABILITY TO USE THIS WEB SITE OR ANY TRAVEL PRODUCT BOOKED BY YOU, OR OTHERWISE ARISING OUT OF THE USE OF THIS WEB SITE OR BOOKING OF TRAVEL PRODUCTS BY YOU, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF CLASSIC VACATIONS, ITS AFFILIATES, AND/OR THEIR RESPECTIVE SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. IN ADDITION, IN NO EVENT SHALL THE TOTAL CUMULATIVE LIABILITY OF CLASSIC VACATIONS, ITS AFFILIATES AND/OR THEIR RESPECTIVE SUPPLIERS TO YOU, ANY TRAVELER FROM WHOM YOU BOOKED TRAVEL, OR ANY OTHER THIRD PARTY ARISING FROM OR RELATED TO THIS AGREEMENT EXCEED THE GREATER OF (I) ONE HUNDRED DOLLARS ($100.00) AND (II) THE AMOUNT THAT YOU PAID TO CLASSIC VACATIONS HEREUNDER FOR THE TRAVEL THAT IS THE SUBJECT OF THE DISPUTE.

Indemnification: You agree to defend and indemnify Classic Vacations, its affiliates, and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines penalties or other costs or expenses of any kind or nature, including but not limited to reasonable legal and accounting fees, brought by: (i) you or on your behalf in excess of the liability described above; or (ii) by third parties as a result of: (a) your breach of these Web Site Terms, Conditions and Notices or the documents referenced herein; (b) your violation of any law or rights of a third party; or (c) your use of this Web site or booking of travel products through Classic Vacations.

Tax Recovery Charge: The tax recovery charge on transactions is a recovery of all applicable transaction taxes (e.g. sales and use, occupancy, room tax, excise tax, value added tax, etc.) that Classic Vacations pays to the vendors (e.g. hotels, etc.) in connection with your travel arrangements. Classic Vacations is not the vendor collecting and remitting said tax to the applicable tax authorities. The vendors bill all applicable taxes to Classic Vacations and Classic Vacations remits such tax directly to the vendor. Classic Vacations is not a co-vendor associated with the vendor with whom we book or reserve our customer's travel arrangements.

Taxability and the appropriate tax rate vary greatly by location. Classic Vacations’ actual tax cost paid to the vendor may vary from the tax recovery charge, depending upon the rates, taxability, etc. in effect at the time of the actual use of the hotel, automobile, etc. by our customer. Classic Vacations does not incur the cost of sales tax from vendors located in Alaska, Delaware, Montana, New Hampshire and Oregon as these states do not impose a sales tax. Also, certain jurisdictions impose a hotel occupancy tax or other type of transaction tax upon the renting of a hotel room, an automobile, etc. The type of tax charged by the vendor will vary by service and location.

USTOA $1 Million Consumer Protection Plan: Classic Vacations, as an Active Member of the United States Tour Operators Association (“USTOA”), is required to post $1 million with USTOA to be used to reimburse, in accordance with the terms and conditions of the USTOA Consumer Protection Plan, the advance payments of Classic Vacations customers in the unlikely event of Classic Vacations bankruptcy or insolvency. Seller of Travel: Classic is registered as a Seller of Travel with the Attorney General of the State of California pursuant to Section 17550 of the California Business and Professions Code, under registration #2079429-50. Registration as a seller of travel does not constitute approval by the State of California.

Modification of these Terms and Conditions: Classic Vacations reserves the right to change the terms, conditions, and notices under which this Web Site and its travel products are offered, and you agree to accept and be bound by those terms, conditions, and notices that are in effect at the time of your booking of travel with Classic Vacations.

General Provisions: This Agreement is governed by the laws of Washington. You hereby consent to the exclusive jurisdiction and venue of the courts in King County, Washington for all disputes related to this Agreement, your use of this Web site, and your travel booked through Classic Vacations. Classic Vacations reserves the right to cancel or alter any itinerary at its sole discretion. The information, rates, and terms and conditions contained on this Web Site are accurate at time of publication and are subject to change without notice.

You agree that no joint venture, partnership, employment or agency exists between you and Classic Vacations as a result of this agreement or use of this Web Site.

Classic Vacations’ performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Classic Vacations’ right to comply with law enforcement requests or requirements relating to your use of this Web Site or information provided to or gathered by Classic Vacations with respect to such use.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and this agreement shall continue in effect. This agreement (and any other terms and conditions reference herein) constitutes the entire agreement between you and Classic Vacations with respect to this Web Site and any travel products booked through Classic Vacations, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and Classic Vacations with respect to this Web Site and any travel products booked through Classic Vacations. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
